These Terms of Sale apply to purchases made on the Italian page of the DILUCA SRL – CAMEO ITALIANO e-store https://www.cameoitaliano.it, subject to the exceptions and changes indicated below.
These Conditions of Sale and the related documentation comply with Part III, Title III, Chapter I of Legislative Decree 206/2005.

Parties and Policies

This website, at the URL “https://www.cameoitaliano.it” (hereinafter, “DILUCA SRL – CAMEO ITALIANO estore”) is operated by DILUCA SRL – CAMEO ITALIANO Italia Srl, with registered office at Via M. Schipa, 115 – 80122 Naples. Tax Code IT03355031216, VAT Number IT03355031216 and registration number in the Naples Company Register REA Number: NA – 593130. Share capital Euro 30,000.00 fully paid. Company subject to the management and coordination of DILUCA SRL – CAMEO ITALIANO, with registered office at Via M. Schipa, 115 – 80122 Naples (hereinafter, “DILUCA SRL – CAMEO ITALIANO”).

Purchasing products on the DILUCA SRL – CAMEO ITALIANO e-store requires the user to accept the DILUCA SRL – CAMEO ITALIANO e-store privacy policy. Users are advised to consult the DILUCA SRL – CAMEO ITALIANO privacy policy for information on how DILUCA SRL – CAMEO ITALIANO Italia and DILUCA SRL – CAMEO ITALIANO collect and process the personal data of users of the DILUCA SRL – CAMEO ITALIANO e-store.

Purchases of products on the DILUCA SRL – CAMEO ITALIANO estore will be governed by the following terms and conditions of sale (hereinafter, the “Terms of Sale”).

1. Notes on these Conditions of Sale

These Conditions of Sale apply to all orders and purchases made on the DILUCA SRL – CAMEO ITALIANO estore.

Regarding purchases on the DILUCA SRL – CAMEO ITALIANO e-store, DILUCA SRL – CAMEO ITALIANO Italia will send its communications electronically via email or electronic communication. By using this online channel, users acknowledge that all declarations of intent, offers, communications, disclosures, and other notices will be issued or provided electronically, except where the law requires them to be in writing.

These Conditions of Sale may be changed from time to time by DILUCA SRL – CAMEO ITALIANO Italia, in accordance with the specification relating to the new effective date of their validity on the DILUCA SRL – CAMEO ITALIANO estore website.

Any changes to the Terms of Sale will apply to orders placed on or after the effective date, provided that the amended Terms of Sale are visible on the site as the applicable terms at that time. Before placing an order, users will be given the opportunity to review these Terms of Sale and will be asked to accept them.

2. Purchase via personal account or in “guest” mode”

To place an order on the DILUCA SRL – CAMEO ITALIANO e-store, the user can create a user account (username and password). The user is responsible for maintaining the confidentiality of his or her password and limiting access to his or her password and account, and assumes responsibility for all actions performed and all purchases made using his or her account.
Alternatively, the user can place the order in “guest” mode, without creating – or logging in – an account.

3. Placing the order

To purchase products on the DILUCA SRL – CAMEO ITALIANO estore, you must:
• have accepted these Conditions of Sale and the privacy policy of the DILUCA SRL – CAMEO ITALIANO estore.

• provide your name and address, telephone number, email address, payment details and other information requested;

• provide a valid delivery address (please note that DILUCA SRL – CAMEO ITALIANO Italia does not deliver to PO boxes or automatic parcel distribution points. Orders are shipped exclusively via a trusted courier).

• in case of payment by debit/credit card, be the holder or authorized holder of a valid debit/credit card to purchase the products; and
• in case of payments made via PayPal, be the holder of a valid PayPal account for the purchase of products.

You can place an order by proceeding to checkout after clicking the "ADD TO CART" button. You agree that your order(s) is/are an offer to purchase the product(s) specified in the order pursuant to these Terms of Sale.

Each product order is considered a separate purchase. All orders are subject to acceptance by DILUCA SRL – CAMEO ITALIANO Italia, which reserves the right to refuse any order without explanation (including, but not limited to, orders suspected of fraud). You will be notified if DILUCA SRL – CAMEO ITALIANO Italia decides not to accept your order.

The user will have the opportunity to review his/her order(s), read and accept the Conditions of Sale, check the total price and characteristics of the order(s) and the information provided, and correct any input errors before confirming the order(s).

4. Order fulfillment and contract formation

Once the order(s) have been finalized on the DILUCA SRL – CAMEO ITALIANO e-store according to the instructions made available on the site through the online ordering procedure, DILUCA SRL – CAMEO ITALIANO Italia will send an email to the email address provided, confirming receipt of the order(s) and indicating the details of the product(s) ordered (hereinafter, the 'Order Receipt Confirmation Email”).

The aforementioned email does not constitute acceptance of the order(s): it is merely a confirmation of receipt of the order(s) by DILUCA SRL – CAMEO ITALIANO Italy.

The contract between the user and DILUCA SRL – CAMEO ITALIANO Italia will be deemed concluded only when DILUCA SRL – CAMEO ITALIANO Italia sends the user an email to confirm that the product(s) has/have been shipped (hereinafter, the ’Shipping Confirmation Email“).

5. Prices, taxes and duties, shipping and handling charges

The price charged for a product will be the price indicated on the information/presentation page relating to the individual product at the time the user places the order, and will be indicated on the confirmation page that will appear to the user on the screen after finalising the order and in the Order Receipt Confirmation Email.

Product prices include VAT (or other applicable taxes or duties), and any shipping and handling charges will be displayed at checkout.

6. Payment

Payments must be made using one of the methods listed below, chosen during the checkout process: VISA, MasterCard, or PayPal.

Credit cards require authorization at checkout. Accepted credit and debit card types are also listed at the bottom of the DILUCA SRL – CAMEO ITALIANO e-store. If DILUCA SRL – CAMEO ITALIANO does not receive authorization, DILUCA SRL – CAMEO ITALIANO reserves the right to cancel the order. The value of the purchase(s) will be charged to the respective card once DILUCA SRL – CAMEO ITALIANO sends the Shipping Confirmation Email.

If paying with PayPal, the value of the purchase(s) will be charged at checkout.

If you purchase with Scalapay, you'll receive your order immediately and pay in 3-4 installments. You acknowledge that the installments will be assigned to Incremento SPV Srl, related parties, and their assignees, and that you authorize such assignment.

7. Delivery

Shipping times, if not indicated at the time the user places the order, will be reported in the order confirmation.

DILUCA SRL – CAMEO ITALIANO Italia reserves the right to replace the courier responsible for delivering the order.

If you, without reasonable cause, postpone delivery, or delay receipt of delivery after DILUCA SRL – CAMEO ITALIANO has notified you that it has attempted to deliver the items you ordered, or if you have provided an incorrect delivery address resulting in delivery failure, the package will be returned to DILUCA SRL – CAMEO ITALIANO and DILUCA SRL – CAMEO ITALIANO will be relieved of its obligation to deliver the items within the established delivery time.

Orders are processed with shipping via express couriers.

DILUCA SRL – CAMEO ITALIANO will not be responsible for delays or failures to deliver if the delay or failure is caused by circumstances beyond its control, including, but not limited to, acts of war or terrorism, strikes, national or local states of emergency, failure of transport infrastructure, interruptions in electricity or other utilities, earthquakes, other natural disasters, or delays or postponements in delivery caused by the recipient.

8. Product availability

If the product you wish to order is no longer available, you will be technically prevented from placing your order on the DILUCA SRL – CAMEO ITALIANO e-store. Furthermore, in a few exceptional and unforeseeable cases, a product listed on the site as available may no longer be available after you place your order. In this case, the contract between you and DILUCA SRL – CAMEO ITALIANO Italy will not be concluded, and you will be notified accordingly. Therefore, the product will not be included in the Shipping Confirmation email sent to you. If payment is made before the Product's unavailability is confirmed (e.g., via PayPal), DILUCA SRL – CAMEO ITALIANO will refund the sums paid by you as soon as possible and in any case within thirty days of DILUCA SRL – CAMEO ITALIANO's notification of the Product's unavailability.

9. Compatibility, product information

When ordering, please ensure that the products you purchase are compatible with your intended use. We encourage you to use the DILUCA SRL – CAMEO ITALIANO e-store as your final point of reference when checking compatibility. In the event of a discrepancy between the content of the DILUCA SRL – CAMEO ITALIANO e-store and any other website (or any other source of information), the product compatibility indicated on the DILUCA SRL – CAMEO ITALIANO e-store at the time of purchase will prevail. Please note that, due to the handcrafted nature of these products and/or the limitations of displaying product images on screen, the exact color, size, and design of the products on screen may differ from the actual product features.

Without prejudice to the foregoing, if the products you have received do not correspond to those ordered, or if the delivery is incomplete or there has been damage during transport, we invite you to contact the DILUCA SRL – CAMEO ITALIANO Customer Service Center immediately for assistance by email or telephone within the legal deadlines.

10. Ownership of the products

Ownership of the products, and the related risk, transfers from DILUCA SRL – CAMEO ITALIANO to the user upon receipt of the products by the latter.

Please note that personalized items are an exception to the Right of Withdrawal and cannot therefore be returned under our Return Policies.

12. Guarantees and legal rights

The user will be covered by the legal guarantee for purchased items that prove to be defective. In such cases, the user can:

  • request the repair or replacement of the product (at its discretion, unless such remedies are excessively burdensome or impossible for DILUCA SRL -CAMEO ITALIANO),

  • If both of the aforementioned primary remedies are excessively burdensome or impossible for DILUCA SRL – CAMEO ITALIANO Italia, the user may request termination of the contract (with a refund of the purchase price by DILUCA SRL – CAMEO ITALIANO, upon return of the products by the user) or a reduction in the purchase price.

The purchased item is free from significant defects if, at the time of delivery, it presents the agreed-upon quality. To the extent that no specific quality has been agreed between the parties, the purchased item is deemed free from significant defects if:

  1. is suitable for the use for which it is intended under the contract; and/or

  2. It is fit for the normal use for which it is intended and its quality is that normally found in items of the same type, and the buyer can expect such quality given the type of item. The term "quality" includes those characteristics that the buyer can expect based on publicly available statements about the specific characteristics of the purchased item made by the seller, the manufacturer, or its representative (for example, but not limited to, in advertising or identification materials), unless the seller was unaware of the statement and was not required to be aware of it, or unless, at the time the contract was concluded, the quality has been modified but is still at the same level, or it was not relevant to the decision to purchase the item.

DILUCA SRL – CAMEO ITALIANO will cover all costs necessary to remedy the defect; specifically, labor and materials. DILUCA SRL – CAMEO ITALIANO may refuse to proceed with the remedy chosen by the user if such remedy is only possible at disproportionate expense. In this context, particular consideration must be given, including but not limited to, the value of the defect-free item, the extent of the defect, and the possibility of resorting to alternative remedies without causing substantial damage to the user. In this case, the dispute will be limited to the alternative remedy; DILUCA SRL – CAMEO ITALIANO also retains the right to refuse the alternative remedy, without prejudice to the requirements set forth in point 1 above. 

If DILUCA SRL – CAMEO ITALIANO supplies a defect-free product to remedy a user’s request for a defective product, DILUCA SRL – CAMEO ITALIANO may request the return of the defective product.

The user has the right to contest the defect of the purchased product only if he or she reports the defect to DILUCA SRL – CAMEO ITALIANO immediately after discovering it, or immediately after he or she should have reasonably discovered it. For this purpose, defect reports made within fifteen days of their discovery are considered timely. The legal guarantee, relating to the non-conformity of a purchased product with respect to what was agreed in the contract, expires two years after purchase, without prejudice to the user's right to request a price reduction or a full refund, as an exception in legal actions aimed at obtaining payment for the price of the purchased items.

Users are required to retain the order confirmation/invoice (and forward it to any recipient of a gift) as the original proof of purchase, which must be attached to activate the legal warranty. Inserting counterfeit charms or charms from other brands on DILUCA SRL – CAMEO ITALIANO bracelets could damage them. Therefore, DILUCA SRL – CAMEO ITALIANO will not be responsible for defects caused by such use, and damage to DILUCA SRL – CAMEO ITALIANO products resulting from such improper use will not be covered by the warranty.

13. Responsibility

These Conditions of Sale establish all obligations and responsibilities of DILUCA SRL – CAMEO ITALIANO regarding the purchase and sale of products through the DILUCA SRL – CAMEO ITALIANO e-store.

In particular, DILUCA SRL – CAMEO ITALIANO does not guarantee that the products are suitable for the purposes/expectations foreseen or requested by the user.

Nothing in these Terms of Sale shall exclude or limit the liability provided by law of DILUCA SRL – CAMEO ITALIANO for death or personal injury caused intentionally by DILUCA SRL – CAMEO ITALIANO through its own negligence or that of its employees, for damages caused intentionally by DILUCA SRL – CAMEO ITALIANO or through gross negligence by DILUCA SRL – CAMEO ITALIANO or its employees, nor shall it limit essential rights or obligations inherent in the nature of the contract, to the extent that the achievement of the purpose of the contract is compromised, or any other liability that by law cannot be excluded or limited.

DILUCA SRL – CAMEO ITALIANO will not be liable for contractual, non-contractual or other liability for financial losses (including, but not limited to, loss of profits, loss of revenues, contracts, business or anticipated savings), loss of data, loss of goodwill or reputation or loss or damage of any kind, or for complaints by the user and/or third parties, except as expressly provided herein, and except for damages arising from the liability of DILUCA SRL – CAMEO ITALIANO for death or personal injury caused intentionally by DILUCA SRL – CAMEO ITALIANO or by the fault of the same or its employees, for damages caused intentionally by DILUCA SRL – CAMEO ITALIANO or by the fault of the same or its employees, and except for those acts that limit essential rights or duties inherent in the nature of the contract, to the extent that the achievement of the purpose of the contract is compromised.

14. Severability

If any provision of these Terms of Sale is held to be unlawful, void, or for any reason unenforceable, that provision will be deemed severable from these Terms of Sale and will not affect the validity or enforceability of any remaining provisions. The unlawful, void, or unenforceable provision will be replaced by a valid provision whose rationale or "economic purpose" comes closest to the unlawful, void, or unenforceable provision.

16. Applicable law

These Conditions of Sale and the purchase of products from DILUCA SRL – CAMEO ITALIANO through the DILUCA SRL – CAMEO ITALIANO estore will be governed by and interpreted in accordance with Italian law.
In the event of disputes relating to the product purchase contract or in any case in relation to the purchase procedure on the DILUCA SRL – CAMEO ITALIANO e-store or in relation to these Conditions of Sale, the user will always have the right to appeal to the Court of his or her place of residence or domicile.
